Standard work permit vs BOI / Smart Visa channel in Thailand

Applicant handing a work permit document file to an officer at a one-stop service counter

Working legally in Thailand requires both the right visa category and a work permit. The standard route runs through the Department of Employment, where the sponsoring company must meet registered-capital and Thai-staff ratio thresholds. BOI-promoted companies and qualifying specialists instead use the One Stop Service / Smart Visa channel, which relaxes the staff ratio and grants longer permissions.

Bottom line: Ordinary Thai employers with standard roles should use the regular route. If the employer holds a BOI promotion certificate, or the applicant is a specialist, investor, senior executive or startup founder in a targeted industry, the BOI / Smart Visa channel is faster and materially more flexible.

Frequently asked questions

Do I need the visa before the work permit?
Yes. You must already hold a visa category that permits employment before filing the work permit; otherwise you convert your status or apply for a new visa abroad.
What happens when I change employer?
A work permit is employer-bound. The old employer files a termination notice and the new application must be filed within the statutory window, or the right to stay lapses.
Who is Smart Visa for?
Science and technology specialists, investors, senior executives and startup founders in targeted industries, with longer stays and lighter reporting duties.
How does your team help?
We pre-screen eligibility, sequence the whole document set, translate and legalize foreign records, file and follow up to collection, and diary renewals for you.

Prefer not to run the paperwork yourself?

Our team is an advisory practice, not just a filing agency. With 15+ years of cross-border document work we map the full route before you spend anything: we confirm what the receiving authority actually accepts, sequence translation, notarisation and legalisation in the right order, forecast a realistic timeline, and flag the details that normally cause rejections. Send us photos of your documents for a free initial assessment.
