Frequently asked questions
Which nationalities get a Thai Work Permit fastest in 2026?
US (Treaty of Amity), UK, Australia, Japan, Korea, Singapore — origin police checks are quick and Apostille is honoured after Thailand's Hague accession takes effect on 14 Feb 2026. End-to-end: about 10-12 business days.
Which nationalities take the longest?
Myanmar, Laos, Cambodia, Vietnam — police documents must travel back to origin and pass a full 4-step legalisation chain (no Apostille shortcut). Typical timeline: 20-25 business days.
How does the US Treaty of Amity help work permit holders?
US-majority-owned Thai companies may conduct most business activities on par with Thai nationals, exempt from the Foreign Business Act's foreign-shareholding limits — except in 6 reserved sectors (communications, banking, transport, agriculture, land, natural resources).
Is China's Apostille (PRC) accepted at Thai MOL?
Yes, since 7 Nov 2023 (PRC joined earlier than Thailand). However, many provincial MOL offices still request the PRC Notary Public red seal alongside — bring both to avoid re-filing.
Must every document be translated into Thai?
Yes — MOL/OSSC require Thai. For third-language originals (Japanese, Korean, Chinese), we recommend the native→EN→TH chain to reduce errors when officers cross-check against the source.
Which nationalities need a sworn translator?
Germany, France, Spain, Italy, Russia — MOL accepts only certified/sworn translators (vereidigter Übersetzer / traducteur assermenté) or an in-Thailand re-translation by a translator certified with the Department of Provincial Administration.
Is the 4:1 Thai-to-foreigner ratio still in force?
Yes: 4 Thai staff enrolled in SSO per foreign hire, plus THB 2M registered capital per foreigner. BOI/IEAT/LTR are exempt; Thai-marriage route is 1M + 2 Thai staff.
Can Non-B + WP be filed outside Bangkok?
Yes, at 11 OSSC centres (BKK, Phuket, Chonburi, Rayong, Songkhla, Chiang Mai, etc.). Some nationalities (MM/KH/LA/VN) must file at OSSC centres with an MOU cell.
Can DTV replace a Work Permit?
No — DTV prohibits working for Thai companies or invoicing Thai clients; it is for remote work with foreign employers/clients only. Any Thailand-facing employment must use Non-B + WP.
Does LTR waive 90-day reporting and re-entry for every category?
Yes, for all four categories (Wealthy Global Citizen, Wealthy Pensioner, Work-from-Thailand Professional, Highly-Skilled). It also unlocks 1:0 hiring ratio for companies employing LTR holders.
